BPSA Legal Coverage

The Border Patrol Supervisors Association (BPSA) is a professional organization — not a union — led by a volunteer board. We facilitate legal defense coverage for our members through group membership in the PORAC Legal Defense Fund (LDF).

PORAC LDF is the largest and most established legal defense fund in the country, run by and for peace officers. BPSA members are enrolled in Plan I, which provides legal representation for civil, criminal, and administrative actions arising from acts within the scope of employment.

Coverage includes:

  • Representation during critical incidents and administrative investigations
  • Defense in civil or criminal proceedings related to duty
  • Support services like expert witnesses, investigators, and court costs when necessary

Is the BPSA a union?

No. The Border Patrol Supervisors Association (BPSA) is not a union. We are a professional association with a volunteer board, dedicated to supporting our members by facilitating access to PORAC Legal Defense Fund (LDF) group coverage. Our role is to ensure members are enrolled, informed, and supported—but we do not provide direct legal representation or act as labor representatives.

What PORAC plan does the BPSA provide?

We provide Plan 1 coverage through PORAC LDF, which includes Administrative, Civil, and Criminal representation.

Is there a cap on benefits?

No. PORAC LDF does not cap legal benefits. The fund has spent over $1,000,000 on individual cases when necessary. In an era of increased scrutiny and severe penalties for law enforcement officers, this level of support is critical. However, PORAC ensures funds are used responsibly, employing experienced panel attorneys who deliver cost-effective representation.

Are letters of reprimand or minor administrative issues covered?

No. PORAC LDF does not cover minor disciplinary matters such as letters of reprimand. The Fund is designed to protect members facing serious discipline, keeping coverage meaningful and rates affordable.

What does “all customary, necessary, and reasonable services related to an action” mean?

This refers to coverage for more than just attorney representation. When appropriate, PORAC will fund litigation aids such as investigators, expert witnesses, polygraphers, transcripts, and other court costs. This comprehensive support helps ensure the strongest possible defense.

Who provides the legal representation?

PORAC LDF uses a vetted panel of expert attorneys and lay representatives with deep experience in peace officer defense. These professionals are recognized leaders in the field and regularly teach at police academies and appear in high-profile law enforcement cases.

How do I file a claim?

Call 888-556-5631. A case coordinator will assess your eligibility for coverage. If the matter is covered, you’ll be referred to your designated panel attorney. The process is quick—most calls take about four minutes.

What if I’m involved in a critical incident after hours?

PORAC provides a 24/7/365 emergency hotline for critical incidents such as officer-involved shootings, in-custody deaths, or vehicle pursuits resulting in serious injury. Call 888-556-5631. You’ll be connected with an answering service that will notify the Administrator. An attorney is typically dispatched within 15 minutes.
